Terms of sale
1. Who sells, to whom
Services are sold by Maxime Silla Pellicer, French sole trader trading as RenewMyPage, 19 Rue des Causses, 91940 Les Ulis, France, SIREN 843 074 303 ("RenewMyPage").
They are for businesses only (companies, self-employed people, associations) buying for their trade ("the Customer"). By ordering, the Customer confirms they act in a professional capacity, so consumer cancellation rights do not apply.
2. Services
RenewMyPage builds or rebuilds the Customer's website, puts it live and hosts it. There are two plans:
- Subscription: build or redesign, hosting, domain name, updates, backups and 2 change requests a month. A request is a simple change: some text, a photo, prices or opening hours. Unused requests do not roll over.
- One-off: build or redesign, with the first year of hosting and domain name. From year two, hosting and domain name cost 99 a year in the contract currency (£, $ or €), paid in advance. Changes are quoted separately.
A change to the structure of the site (new page, new feature, new design) is not covered by the monthly requests and is quoted separately.
The site can be offered in up to 4 languages, chosen when ordering. The included domain name is a standard one (.com, .co.uk, .fr or similar); a more expensive name (rare extension, "premium" name) is charged to the Customer at cost. Hosting covers normal use of a business showcase site.
3. Preview and order
Before any order, RenewMyPage may show the Customer a preview of their future site at an unindexed address. The preview is free and commits the Customer to nothing. It is deleted no later than 30 days after it is sent, or sooner on request.
An order is placed by paying online for the chosen plan, or by accepting a quote in writing (email included). It means acceptance of these terms in the version in force on that day.
4. Prices and payment
Prices are shown on renewmypage.com or on the quote. No VAT is charged (art. 293 B of the French General Tax Code). Customers established outside France are responsible for any taxes due in their country.
- Monthly subscription: paid in advance each month by card or direct debit. Yearly subscription: paid in advance for 12 months.
- One-off: paid in full when ordering.
An invoice is emailed for each payment. Late payment incurs interest at three times the French legal interest rate and a fixed recovery fee of €40 (art. L441-10 of the French Commercial Code). If a reminder goes unanswered for 15 days, RenewMyPage may suspend the site until payment.
5. Subscription term and cancellation
The subscription runs for a fixed term of 12 months from the day the site goes live. It then continues month to month and can be cancelled at any time by email with one month's notice. A yearly subscription renews for 12 months unless cancelled by email at least one month before it ends.
On cancellation, the site stays live until the end of the paid period. The Customer can then take back their domain name (see section 7) and the content of their site (text and photos). They can also buy the full site: the price is the one-off price minus what was already paid for the subscription, and never less than £290, $290 or €290.
6. Going live and Customer duties
RenewMyPage puts the site live within an indicative 7 days of the order and of receiving what was asked of the Customer (changes, photos, access to the domain name if needed).
The Customer provides accurate information and content (text, photos, logos) they hold the rights to. They remain responsible for what is published on their site and for its legal notices. RenewMyPage may refuse unlawful content.
7. Domain name
If the Customer already has a domain name, they keep it: RenewMyPage explains the settings needed to connect the site, or makes them with the Customer's agreement. RenewMyPage does not change the Customer's email.
If the Customer has no domain name, RenewMyPage registers one in the Customer's name and renews it while the contract runs. When the contract ends, RenewMyPage transfers the domain name free of charge to the Customer or their chosen provider on request.
8. Ownership of the site
Content supplied by the Customer remains theirs. With the one-off plan, once paid, the Customer may use, modify and host the delivered site wherever they like; files are supplied on request. With the subscription, the Customer has the right to use the site for as long as the subscription runs. RenewMyPage keeps its tools, templates and methods in all cases, and may show the site as an example of its work unless the Customer objects.
9. Hosting and liability
RenewMyPage does its best to keep the site available at all times but cannot guarantee it will never be interrupted (maintenance, a provider outage). Sites are backed up.
RenewMyPage is only liable for direct, proven damage, capped at the amounts paid by the Customer over the last 12 months. RenewMyPage does not guarantee any search engine ranking or number of customers.
10. Personal data
Data processing is described in the privacy policy. Where the Customer's site collects visitor data (contact form), the Customer is the controller and RenewMyPage acts as processor, only to host the site and pass messages on to the Customer.
11. Governing law and disputes
These terms are governed by French law. In case of disagreement, the parties first try to settle it amicably by email. Failing that, the dispute goes to the competent courts for RenewMyPage's business address.
